Although it might seem self evident, it is often not. Who are the parties to the dispute? Who would be the named plaintiff and defendant in any litigation? What do they do? Where are they? Often, in answering these basic and preliminary questions, one uncovers information that is helpful in charting a course forward. For example, is the defendant an individual or corporation? Where is the corporation incorporated? What is the real name of the corporation? Who owns the corporation? In what type of business is the corporation engaged? How long has it been in existence?
